We had so much fun! Your house is just amazing for a large group. We all slept well, and the older "kids" had tons of fun in the pool and with the pool table.
Terms and Conditions of Booking
The Water’s Edge, Formosa Gardens Estate, Florida
The signing of the booking form confirms the acceptance of the terms and conditions set out below and shall be binding on all the persons intending to occupy the property whether or not such persons have signed the booking form. The Owners will confirm each booking as soon as possible after receipt of the signed booking form and deposit is received. Once the Owners have issued the booking confirmation the signatory is responsible for the total price of the rental property as agreed. The remaining balance must be paid 12 weeks prior to arrival. If the full balance is not paid 12 weeks before arrival, we reserve the right to cancel your booking. The reservation deposit will be forfeited.
2. BOOKING CANCELLATIONS
If you or any member of your party wishes to cancel the whole or part of the booking once it has been confirmed, we must be informed in writing or by email. The following cancellation charges will apply:
Security Deposit is fully refundable.
Cancellation Prior to 12 weeks of the rental – Loss of deposit only.
Cancellation Less than 12 weeks – Loss of total rental charge.
Minimum booking is 6 days, please ask about odd days and fill-ins.
3. SECURITY DEPOSIT
Upon signing the rental agreement the signatory agrees to pay for any damage of any kind to the property from the security deposit. This deposit is fully refundable after your departure from the property, providing there are no claims made against it. In the event of any excess damage of any kind to the property or excess cleaning costs or excessive use of electricity (e.g. leaving external doors open with air conditioning on) which exceed the security deposit of 500 the signatory will be held responsible for all additional costs.
4. LIABILITYThe Owners and management Company of the property accept no responsibility whatsoever for the death, personal injury, accidents, loss, or damage to persons or personal belongings however caused. The use of all accommodations and all amenities, including the swimming pool and hot tub is entirely at the users own risk. Children must al all times be supervised by responsible adults when using the swimming pool and at no time at all are the pool and deck doors’ alarms to be tampered with. GLASS is not permitted within the pool area. The Owners and Management Company cannot accept any liability for any loss of rental time due to travel problems, flight delays, cancellations, terrorist acts, industrial disputes Mechanical Breakdowns in the home, or any other events, which are outside our control, including any form of Force Majeure.
The guests are responsible for the property, and are expected to take all reasonable care of it including the locking of all doors and windows and ensuring the security alarm is activated whenever the house is unoccupied. At the end of the rental period, all equipment including everything in the house all walls, carpets and furnishings must be left clean and tidy.
6. PARTY SIZE
Everyone occupying the house, must be listed on the booking form, this includes small children. This is Florida State law and must be adhered to. The accommodation cannot be shared, assigned or sub-let and only persons shown on the booking form are permitted to stay in the property. NO PETS ARE PERMITTED. Persons under 25 years of age are not acceptable unless accompanied by parents or responsible adults. This property is fully licensed for short-term rental in Florida. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
7. ARRIVALS AND DEPARTURES
The house will be available for occupancy from 5.00pm on the day or arrival and must be vacated by 10.00am (prompt on day of departure).
For the safety and comfort of all our guests smoking is not permitted within the property. Thank-you.
9. POOL HEATING
Pool heating should be requested at the time of booking, If you want the Hot Tub “Hot” you will need pool heating. There is an additional charge for this. In the event pool heating is requested and paid for, the owners cannot guarantee the temperature of the pool as this will vary according to different factors, predominantly the weather conditions at the time. The owner or owner's agent will not be held responsible for any electrical or mechanical failure of pool heating equipment.
Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. “The Waters Edge” is treated regularly as part of a pest and termite control program. Keep all windows and external doors closed whenever possible; not only will this help to keep bugs from the property, but it will also enable the air conditioning unit to function more efficiently
10. CODE OF CONDUCTvFormosa Gardens Estate is a residential community. Nothing should interfere with the quite enjoyment of other holidaymakers and residents. Please do not swim, play loud music, or do anything else which is likely to inconvenience your neighbours after 22.30pm or before 7.30am. In the event that anyone in your party behaves in a way which our management company believes is likely to cause danger, distress or annoyance to any one else on Formosa Gardens Estate, or damage any property on Formosa Gardens Estate, the Owners or the Management Company shall not be responsible for any cost you will incur, nor shall we pay any compensation, nor make refunds due to this action. Vehicles: No trailers, trucks, U-hauls, RV’s, camper vans or anything similar are permitted to park anywhere on the sub-division and the guest/owner will be requested to remove the offending vehicle(s). Failure to do so will result in the Sheriff being requested to press charges and the vehicle(s) removed.
No vehicle may be parked on the road overnight; you will pay a heavy fine and the vehicle towed by the Sheriff. No vehicle to be parked on the grass verges or in such a manner that it blocks a sidewalk.
Garbage: You must dispose of garbage in the manner directed by the County and the HOA. You must provide sufficient garbage cans with secure lids to be placed at the side of the road for collection on Monday and Thursday morning. The collection service can be any time from 7am and so it is acceptable to place them at the roadside the previous evening. Under no circumstances is it acceptable to place plastic bags, loose cardboard box, cans, bottles or foodstuff at the roadside. If it doesn’t fit in the garbage can, then arrange with the County for disposal. If you have too much garbage, buy more bins or wait until the next collection day. Cans must not be left at the roadside earlier than the day before collection and empty cans removed by the morning after collection day.
11. INSURANCE (Highly Recommended to cover booking cancellations)
It is a condition of this booking that all members of the party are covered by travel insurance, which carries adequate protection against delays and cancellation, and has adequate medical insurance for the USA and for your luggage and personal belongings.
12. FORCE MAJEURE
As with any other holiday, there may be circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but no limited to) destruction of or severe damage to the property. Such circumstances are referred to as “Force Majeure”. In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the owner’s liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, however arising.
This contact is subject to and shall be construed in accordance with the laws of Great Britain and all parties hereby submit to the exclusive jurisdiction of the British Courts.
14. OWNERS ACCESS
The Owners or their Management Company shall be allowed access at any reasonable time during your stay.
